Terms and Conditions of Use of Service
By placing an order, you are licensing our software. With the
software license you agree to the following conditions;
1. "Knowledge Download" cannot be used for the following
types of web sites: Any websites containing ebooks, digital
products, or other publications including videos, audio recordings
or tapes, or any services relating to racial hatred, pornographic
materials, obscenity, illegal activities, content for SPAM,
violence, or any unlawful content. Web sites offering products
for which they do not own the rights to distribute or resell.
Customers found using the software for any of the above purposes
will have their account immediately terminated and will be notified
in writing. No refund of any monies paid for the software will
be refunded to the customer in such cases. You cannot resell
any of the additional sites you create and you must own the
domains you update from them. The sites are for your use only.
Anyone found reselling sites will have their account terminated
immediately.
2. We bill our service monthly $14 will be charged
to your credit card each month. You have a Bullet-Proof Risk
Eliminating Guarantee. During any month, for your lifetime,
you can determine the suitability of the software, the ebook
mini web site and any services we provide. You can ask for a
refund within any month. Upon asking for a refund, your account
will be terminated and you will no longer be able to access
the online software, or be able to change or update any of your
mini-sites you have created.
3. Knowledge Download, Oliver Tucker Partners,
LLC, or their associated companies and partners take no responsibility
for the performance of the web host you chose to host your mini-sites
outside of the Knowledge Download domain.
4. Email support is limited to technical issues
arising from the use of the software and services only. Support
does not include advice on use of Microsoft Word, Microsoft
Internet Explorer, Clickbank or PayPal account questions.
5. Knowledge Download, Oliver Tucker Partners,
LLC, and their associated companies and partners reserve the
right to upgrade, make changes to the software, add improvements
or include additional features to improve the software performance
as deemed necessary. All customers will automatically have access
to the latest versions.
6. From time to time, and on rare occasions the
software may not be accessible due to technical difficulties,
Internet bandwidth, or server downtime. As such, Knowledge Download,
Oliver Tucker Partners, LLC, and their associated companies
and partners will not be held responsible for these periods
the software may be inaccessible.
7. Knowledge Download, Oliver Tucker Partners,
LLC, and their associated companies and partners will not be
held responsible for technical issues, bandwidth, downtime or
performance related to the hosting of your mini-sites with an
outside web host. Problems of this nature should be directed
to your outside web host.
8. As a licensee of the software and service,
you agree to important updates and any notifications pertaining
to the online software or service being sent to you at the email
address you give at the time of placing your order. Should you
wish to change your email address for such notifications, such
notification must be emailed to the contact email address found
on the Contact page of Knowledge-Download.com. However,
email notifications may or may not be made and are at the sole
discretion of Knowledge Download, Oliver Tucker Partners, LLC,
or their associated companies or partners.
9. The software and it's code is protected under
international copyright laws, and cannot be copied, resold,
relent, hired out, licensed or reverse engineered under any
circumstances. Copying by any means including electronic methods,
transmission by voice, electronic mail, posting to a web site
or uploading to an ftp site or CD duplication is strictly forbidden.
Legal action will be taken against offenders.
10. The fee paid for the use of the online software
and service does not include web hosting of your sites outside
our domain, Clickbank or PayPal establishment fees or any other
costs associated with running the sites you create including
any ISP fees for access to the software of your mini-sites.
11. You agree not to give your unique assigned
"user ID" or "password" to access your "control
panel" or account to any other person or third party. Knowledge
Download, Oliver Tucker Partners, LLC, and their associated
companies and partners will not be responsible for actions resulting
from misuse of your access account or password and identification
details.
12. To use the software you agree and understand
that you will require and are proficient in the use of Microsoft
Internet Explorer version 5.5 or higher. Should you choose to
use Microsoft Word to prepare content for your mini site, you
agree and understand that you will alone are responsible for
your proficiency of that tool and that you also agree that you
can only use Microsoft Word version 97 or 2000. The cost of
these software tools is not included in the service fee. You
will also require either a PayPal or Clickbank account to be
able to accept payment for products sold on the mini-sites you
create. If you do not have an account with either of these providers,
you are required to establish one in order to use the Knowledge
Download electronic commerce and ebook download features.
13. Affiliates for the Knowledge Download program
agree not to promote the program in any manner that misinterprets,
or offers any benefits, features or inclusions not offered in
the software or service. Affiliates are prohibited from the
use of sending unsolicited commercial email, or SPAM to promote
Knowledge Download or our services. Affiliates found or reported
to violate these rules will be terminated immediately and all
unpaid commissions will be forfeited.
14. Knowledge Download, Oliver Tucker Partners,
LLC and their associated companies and partners will not be
held responsible for non-performance or technical difficulties
arising from the use of any Clickbank or PayPal account used
in conjunction with the software.
15. Should payment by credit card be declined,
or unable to be obtained from the customer's credit card details
supplied following authorization, the customer's account will
be terminated unless alternative payment is made following a
request by email within 7 days.
16. You are prohibited from selling any mini-site
you create to a third party. Individual "user ID's"
and "passwords" cannot be allocated to individual
mini-sites you create. All mini-sites created with the software
can only be updated or changed through your main account.
17. While every effort has been made to
make the software "bug free" and free of any coding
errors which may affect performance of any mini-site created,
Knowledge Download, Oliver Tucker Partners, LLC or their associated
companies and partners accept no liability or responsibility
to any person or entity with respect to any loss or damage or
alleged to be caused directly or indirectly by the use of the
software.
